Fan-site disclaimer

Barstool Bush is an unofficial, independently-run fan site. It is not affiliated with, endorsed by, or sponsored by Barstool Sports, its parent companies, its talent, or any person featured on the site. All references to Barstool brands, shows, personalities, and trademarks are nominative and used for the purpose of identifying the content being discussed.

Likewise, the site is not affiliated with, endorsed by, or sponsored by any sportsbook, exchange, prediction market, or data provider referenced on the site, including (without limitation) Pinnacle Sports, Polymarket, Kalshi, or DraftKings.

Eligibility

You must be at least 18 years old to use this site, and at least 21 years old to view or rely on any sports-wagering, prediction-market, or event-contract content. By using the site you represent that you meet these requirements and that your use of the site is lawful in your jurisdiction. Sports wagering and event contracts are not legal everywhere — you alone are responsible for confirming that participating in those markets is permitted where you live.

Content ownership

Embedded tweets, photos, and other third-party media remain the property of their original creators (Barstool Sports, individual talent, the posters, etc.). They are displayed via links and standard embedding tools and credited back to their source. Editorial commentary, summaries, and original writing on this site belong to Barstool Bush.

Sports markets & odds — informational only

Odds, spreads, totals, prediction-market prices, fee-adjusted views, expected-value (EV) calculations, win-probability estimates, and similar data are displayed for informational and entertainment purposes only. None of it is gambling advice, investment advice, financial advice, tax advice, or a recommendation to place any wager or buy any event contract.

Lines move. Models can be wrong. Data feeds can lag, drop, or return stale prices. Past results do not predict future outcomes, and a positive-EV display at any moment is a model output — not a promise of profit. You alone are responsible for any wager you place, any contract you buy or sell, and any loss you incur as a result. We do not accept, process, settle, or facilitate any wager or contract.

Prediction-market and event-contract prices shown on the site (including Polymarket and Kalshi data) reflect third-party trading activity. Kalshi event contracts are regulated by the U.S. Commodity Futures Trading Commission; Polymarket markets may be unavailable or unlawful in your jurisdiction. Trade only on a platform that is licensed and permitted in your location, and only with funds you can afford to lose.

Affiliate disclosure

The site does not currently participate in any sportsbook, exchange, or prediction-market affiliate program, and we receive no commission from any wager, contract, or signup. If that ever changes, affiliate links will be labeled and this section will be updated.

No warranty

The site is provided "as is" and "as available", without warranty of any kind — express, implied, or statutory — including (without limitation) implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do our best to keep everything accurate, fast, and online, but make no guarantee that any data — including odds, prices, scores, schedules, or article content — is correct, complete, current, or uninterrupted. Use at your own risk.

Limitation of liability

To the maximum extent permitted by applicable law, Barstool Bush and its operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or opportunity, arising out of or relating to your use of the site, your reliance on any data or content displayed on the site, including any wager, trade, or event-contract decision. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Where liability cannot be excluded as a matter of law, our total aggregate liability to you for all claims arising out of or relating to the site is limited to US $100.

Indemnification

You agree to defend, indemnify, and hold harmless Barstool Bush and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any wager, trade, or event-contract decision you make in connection with content displayed on the site.

User content

Anything you post or submit on the site — forum posts, game entries such as Balderdash answers, display names — remains yours, but by submitting it you grant us a non-exclusive, royalty-free license to display it on the site as part of the feature you submitted it to. Don't submit anything unlawful, infringing, harassing, or that exposes someone's private information. We may remove any user content or restrict access at our discretion, with or without notice. Game submissions are ephemeral and are deleted shortly after a game ends.

Removal requests & copyright

If you're a rights holder and would like a piece of content removed, reach out via @Barstool_Bush on X with the URL and a brief description of the claim, and we'll review and remove it promptly. We comply with the Digital Millennium Copyright Act (DMCA) and respond to properly- formatted takedown notices.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the site shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.

Changes

These Terms may be updated occasionally. The "updated" date at the top reflects the most recent change. Continued use of the site after a change means you accept the updated Terms.

Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
